Use of the Website

Massy Motors Rentals SAS. (“Enterprise”) offers the use of this website at no additional cost for the benefit of its subsidiaries and licensees/franchisees who operate the Enterprise Rent-A-Car System worldwide.

Web Site Services

The services provided include, but are not limited to:

• Provide options for using the site in accordance with these terms of use.
• Provide information about vehicles, pickup locations, rental rates and current special offers.
• Allow customers to finalize reservation requests for car rentals
• In some cases, it allows pre-paid reservations.

Availability of the Website

Enterprise intends to maintain the website permanently, but does not guarantee your continued access. If the website is closed, Enterprise will inform users in advance by means of a notice on the website.

Changes to the Website

Enterprise reserves the right to modify, expand or reduce the content, structure and design of the website.

Availability and Maintenance

Enterprise does not guarantee the geographical or temporary availability of the website. Restrictions may apply for technical or legal reasons, including maintenance tasks and security updates.

2. Reservation Requests

Informational Nature of the Website

This website is an information and reservation service, but it does not offer the possibility of entering into rental contracts, which must be formalized at the branches of Enterprise and its franchisees.

Types of Reservations

The website can offer two booking options:

• Reservations paid in advance: Binding under the terms of Pay Now.
• Non-binding reservation requests: They can be canceled without liability for either party.

3. User Account

There is no need to register to use the website, access information or make reservations.

4. User Obligations and Consequences of Infringements

Allowed Use

The website and its database can only be used in accordance with these conditions.

Prohibited Actions

The user will not be able to:

• Submit viruses or malicious software.
• Interfering with the operation of the website or overloading its infrastructure.
• Block, overwrite, or modify Enterprise content.
• Use automated methods to search for vehicles or generate quotes.

Enterprise assumes no responsibility for advertisements or information provided by business partners.

Limited Liability

Enterprise will only be liable in cases of gross or intentional negligence.

Force Majeure Cases

Enterprise is not responsible for interruptions caused by force majeure, such as failures in telecommunications networks.

Data Loss

Enterprise is only responsible for data loss in the cases detailed in the previous clauses.

Application of Limitations

The limitations of liability also apply to legal representatives and agents of Enterprise.

7. Divisibility and Waiver Clause

If any provision of these conditions is found to be invalid, the rest will remain in effect. Failure to enforce a clause does not imply its waiver.

8. Applicable Law

Applicable Legislation

• If you access a website with a domain from your country of residence, the laws of that country will apply.
• In other cases, these conditions will be governed by the Laws of England and Wales.
• It excludes the United Nations Convention on the International Sale of Goods.
